[ March 2011 ] 1 Name The club shall be called The Musselburgh Bowling Club Ia Equity Statement and Policy Musselburgh Bowling Club is strongly committed to equal opportunities for all sectors of the community. It is the policy of Musselburgh Bowling Club to ensure that all members, participants, volunteers, visitors and guests receive equal treatment regardless of age, gender, marital status, employment status, social class, colour, race, ethnic or national origin, religious belief or disability. All members are expected to support the club in the achievement of this. II Object The object of the club is to promote the sport of bowling by participation in competitive and friendly games; for which purpose the rules of the Scottish Bowling Association, Midlothian Bowling Association and Esk League shall be adhered to except in so far as otherwise governed by the bye-laws of the club. III Membership 1 Membership of the club shall consist of Members, Senior Members, Junior Members, Associate Members [bowling], Associate Members [non-bowling], Life Members and Honorary Members. 2 The name and address of each applicant for [all classes of] membership, with the names of the Proposer and Seconder must be posted on the notice board at least two weeks before being considered. Applicants may be elected, by a majority, at either a General or Council Meeting. 3 Members shall: (1) have full use of the green and clubhouse at all times. (2) be eligible to play in all competitions, club selection games and friendly games (3) be eligible to take part in all votes and resolutions at the Annual General Meeting or any Special General Meeting of the club (4) be eligible for election to office within the club 4 A member who has attained 65 years of age and has had 10 continuous years of membership of the club shall automatically qualify for Senior Member status. Senior Members shall enjoy the same rights and privileges as Members. 5 An applicant who is under the age of 18 shall, if accepted, become a Junior Member of the club. Junior Members shall: (1) have full use of the green at all times (2) be allowed to play in club competitions and be eligible for club selection games (3) be allowed to participate in club ‘hat games’ and friendly games (4) have the use of the clubhouse in accordance with the Licensing Scotland Act 2005 and the club bye-laws (5) have no voice in the management of the club 6 Associate Members [bowling] shall: (1) have the use of the green afternoons only from Monday to Friday but will be allowed to participate in ‘hat games’ and friendly games (2) not be allowed to compete in club competitions nor be eligible for club selection games (3) have the use of the clubhouse at all times (4) have no voice in the management of the club (5) not exceed in number one fifth of the ordinary/senior members 7 Associate Members [non-bowling] shall: (1) have the use of the clubhouse at all times (2) have no voice in the management of the club (3) not exceed in number one fifth of the ordinary/senior members 8 Persons who have rendered services to the club may be admitted as Life Members by a majority at any general meeting of the club on the nomination of any two members previously submitted to, and approved by, the Council. Life Members shall not exceed in number one tenth of the ordinary/senior members and shall have no voice in the management of the club. 9 Persons who have rendered services to the club or the locality, or who are renowned in the game of bowls, may be admitted as Honorary Members by a majority at any general meeting of the club on the nomination of any two members previously submitted to, and approved by, the Council. Honorary Members shall not be allowed to compete for any major trophy and shall have no voice in the management of the club. 10 The entry fee for new members and annual subscription for all classes of membership shall be fixed at the Annual General Meeting and will become effective on 1st March in the following year. Annual subscriptions must be paid to the club Treasurer by 1st March each year. Fees for new members will become payable when membership has been approved. 11 Members wishing to resign their membership must inform the Secretary in writing before the annual subscription becomes due or be held liable for the subscription for the current year. 12 If any member shall act contrary to the Constitution or the interests of the Club, or make themselves offensive to other members, they may be expelled from the Club on a motion to that effect passed at a meeting of the Council, provided that intimation of the motion has been given to the member in question at least three days prior to the meeting and said member has been afforded the opportunity of explanation. The resolution of the Council to expel any member shall be subject to review by a General Meeting of the Club provided that said member makes a written request for such a review within one week after the Council meeting. At such a General Meeting the resolution to expel must have the support of two thirds of the members present and voting. A member expelled shall forfeit all rights and interest in the Club and shall not be allowed to enter the Club premises thereafter on any pretext whatsoever. IV Office Bearers The Office Bearers shall consist of President, Vice President, Secretary, Treasurer, Match Secretary and Green Ranger who shall be elected at the Annual General Meeting [ AGM ]. V Management 1 The Office Bearers and six other Members/Senior Members appointed at the AGM shall form the Council of Management. The two Members/Senior Members whose names stand first on the list of Council shall retire annually and shall not be eligible for re-election until after the elapse of one year. The AGM shall elect two Members/Senior Members to fill the places of those retiring and their names shall be placed last on said list. 2 The President or, in his absence, the Vice President shall be Chair of the Council; if both are absent the Council will appoint one of their number to Chair the meeting. The Council shall have the power to sub-commit. 3 Any vacancies that occur in the Council during the year may be filled by co-option to the Council and members so elected shall remain in office until the next AGM when they will be eligible for re-election. 4 The Council shall have the power to make regulations for the management of the Club which the Secretary shall post in the Clubhouse and such regulations shall be binding on every member. It is the responsibility of each member to consult the notice board on a regular basis and comply with Council instructions/regulations. 5 No office bearer or member of the Council, and no Manager or Servant employed in the Club shall have any personal interest in the sale of alcoholic liquors therein, or in the profits arising from such sales. 6 Alcoholic liquors will only be sold or supplied for consumption within the Club premises. 7 The Club premises shall be registered for the sale of alcoholic liquors under the Licensing Scotland Act 2005. The Club Council shall determine the hours of opening under the Licensing Scotland Act 2005. VI Secretary The Secretary shall conduct the correspondence of the club and give three days notice of all meetings except the AGM or any Special General Meeting; during the bowling season meetings of the Council may be convened by a notice on the board two days prior to the meeting. The Secretary shall record the minutes of each meeting in a book and submit all minutes for approval at the next meeting. The Secretary will also keep a register of members of the Club and supply each new member with a copy of the Constitution and Bye-Laws. The Secretary shall inform the Licensing Authority of all changes in Office Bearers and/or Council. VII Treasurer The Treasurer shall receive and disburse monies belonging to the Club and keep an exact record of same in a Cash Book. The Treasurer shall deposit all monies received in the bank in the joint names the President, Treasurer and one other designated office bearer, reserving an adequate sum in cash to meet current expenses. The books of the Club shall be audited by an accountant appointed by the AGM. An abstract of the accounts, duly docketed and signed by the auditor, shall be submitted to the AGM by the Treasurer. VIII Match Secretary The Match Secretary shall keep a record of all matches and competitions engaged in by the Club and attend the Annual General Meeting of the Midlothian Bowling Association to arrange matches for the year. IX Green Ranger Subject to the control of the Council the Green Ranger [or Sub-Ranger] shall superintend the green and the Green Keeper and, if he considers the green unfit for play, shall notify the same by putting up the board marked ‘Green Closed’. No member shall interfere with said board or play on the green until this restriction is removed. The Green Ranger shall have the power to appoint a Sub-Ranger ; in the event of neither being available the Senior Official present shall decide if the green is playable. X Trustees There shall be six Trustees of the Club, who shall be elected by the members at the AGM, three to form a quorum. Trustees shall continue in office until death or resignation or until a new Trustee or Trustees shall be appointed in their place by a General Meeting of the Club. Six days notice of a meeting to appoint new Trustees must be given to every member. The heritable property of the Club shall be vested in the Trustees and the survivors or survivor of them and their successors in office. The Trustees shall have full power to sell, feu, lease or otherwise dispose of the Club’s property, and to borrow money on the security thereof and to subscribe all necessary deeds, which deeds shall be binding on the whole members of the Club, present and future, as effectually as if they had subscribed the same. However, the powers above given shall be exercised only on behalf of the Club and at the request of the members present at a General Meeting convened for that purpose, of which meeting every member shall receive six days notice; and, the resolution to so dispose of the Club’s property shall require the support of two thirds of the members present and voting at any such General Meeting. XI Meetings 1 The Annual General Meeting of the Club shall be held in March for the purpose of electing Office Bearers and transacting any other business of the Club. Members shall receive at least six days notice of the AGM. 2 The Council of Management shall hold meetings at least once per month during the playing season. 3 The President, or any three members of the Council, shall at all times have the power to call a meeting of the Council. 4 A majority of the full Council shall have power, at any time, to call a Special General Meeting [SGM ] of the Club. 5 The Council shall call a SGM of the club when presented with a requisition signed by twenty members of the Club asking them to do so. 6 At all Council meetings five shall form a quorum ; at General Meetings ten shall form a quorum; in each case the Chair shall have a deliberative, as well as casting, vote. XII Guests/Visitors 1 Officials and members of visiting teams/clubs will be deemed temporary members of the Club and be admitted to share in the facilities of the Club during their temporary stay. 2 A member may introduce guests as specified in the Bye – Laws of the Club. Guests’ names and addresses, date of visit and the name of the introducing member must be entered in the Visitors Book provided for that purpose. 3 Visitors shall not be supplied with alcoholic liquor in the Club premises unless at the invitation, and in the company, of a member. 4 Alcoholic liquors shall not be supplied to persons under eighteen years of age.
XIII Matches and Competitions 1 The Council shall have full power to determine which matches shall be played by the Club and shall adopt such regulations for same, and for Club Competitions and the playing of ties, as they deem proper. 2 At the AGM Skips shall be elected, from those duly nominated at the meeting, who shall play the Club matches. Skips representing the Club at the various trophy competitions run by the Scottish and Midlothian Bowling Associations shall be chosen by the Council. 3 The Club Champion for the year shall have the option of playing in the Scottish Singles Championship or the Rosebery Cup Competition the following year and the Championship Runner-up shall represent the Club in the other.
XIV Alteration of Constitution This Constitution shall not be altered except at an AGM or a SGM of the Club called for that purpose. Any proposed amendment(s) must be submitted to the Council fourteen days prior to the meeting and members shall be given six days notice of the meeting.
Bye – Laws 1 The Club will take no responsibility for any article taken into or left in the premises of the Club. 2 Each member will have the privilege of introducing visitors or guests to the Club premises; such introduction shall be limited to six visitors or guests on any one day. 3 All complaints shall be made in writing to the Secretary who will submit all such complaints to the Council. 4 With the exception of the conditions specified in the following paragraph Club dress shall be black blazer, grey trousers, white shirt and Club tie. Club dress shall be mandatory for semi – finals and finals of Club competitions. 5 Approved Club polo shirts, as registered with the SBA, may be worn in SBA, MBA and Esk League matches. The Council shall reserve the right to vary the dress code for friendly matches etc. 6 Jeans shall be permitted on the green only for practise sessions/games. At all times when using the green members shall be expected to dress appropriately; shorts, tops without collars, football colours/logos or other logos which may cause offence are not acceptable. 7 Mobile phones should be switched off during Club competitions and may not be taken onto the green during SBA or MBA matches. 8 Members shall be expected to observe etiquette when moving around the green when play is going on so that players are not distracted. 9 Members shall be expected, as a matter of courtesy, to put forward the name of their opponent when losing or forfeiting a tie. 10 Members shall conduct themselves appropriately at all times by refraining from the use offensive or abusive language. 11 Members shall not stand or sit on the bankings or take drinks on to the green at any time. 12 Members shall be expected to respect the privacy of the Club’s neighbours by leaving the premises quietly at all times.
